Agreement to Terms

These Terms and Conditions ("Terms") govern your use of the website located at mercedinsulation.com (the "Site"), operated by Merced Insulation ("Company," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

Site Purpose and Content

The Site is provided for informational purposes and to allow prospective customers to contact us regarding insulation services. The information on the Site — including service descriptions, service areas, pricing indications, and project timelines — is provided in good faith but does not constitute a binding contract or guarantee of availability. Actual pricing and scope are determined on a per-project basis through a written estimate.

Estimate Requests and Contact Forms

When you submit an estimate request or contact form on the Site, you authorize us to contact you by phone or email using the information you provide. Submitting a form does not create a contract for services. All services are subject to a separate written estimate and mutual agreement before any work begins.

Service Terms (Project Work)

The following terms apply to all insulation and related work performed by Merced Insulation at a customer's property:

• Written Estimate Required. No project will begin without a written estimate reviewed and accepted by the customer.
• Scope of Work. Work performed is limited to the scope described in the accepted written estimate. Any additions or changes must be agreed to in writing before they are performed.
• Access and Site Conditions. The customer is responsible for ensuring reasonable access to the areas to be worked on (attic, crawl space, walls, etc.) on the scheduled date. If access is blocked or unsafe conditions are present, work may be rescheduled and a trip charge may apply.
• Payment. Payment terms will be specified in the written estimate. Unless otherwise stated, payment is due upon completion of the project. We accept check, cash, and other payment methods disclosed at time of estimate.
• Workmanship. We warrant that work will be performed in a workmanlike manner consistent with applicable building codes and manufacturer installation guidelines. Any defects in workmanship reported within 30 days of project completion will be corrected at no charge, provided the defect is not caused by third-party modifications, settling, or pre-existing structural conditions.
• Materials. Materials are warranted to the extent of the applicable manufacturer warranty. We do not extend any additional warranty on materials beyond manufacturer terms.
• Cancellation. Projects may be cancelled prior to the start of work without penalty. Cancellations after materials have been purchased may result in a restocking or materials fee as noted in the written estimate.

Intellectual Property

All content on the Site — including text, photographs, graphics, and logos — is owned by or licensed to Merced Insulation. You may not reproduce, redistribute, or use any content from the Site for commercial purposes without our prior written permission. Personal, non-commercial use is permitted provided you maintain all copyright and other proprietary notices.

Limitation of Liability

The Site is provided on an "as is" basis. To the fullest extent permitted by applicable law, Merced Insulation disclaims all warranties, express or implied, regarding the Site and its content. In no event shall Merced Insulation be liable for any indirect, incidental, or consequential damages arising from your use of the Site or inability to use the Site. Our liability for direct damages, if any, shall not exceed $100.

Third-Party Links and Services

The Site may contain links to third-party websites or use third-party services (such as embedded maps or contact form providers). These third parties operate under their own terms and privacy policies. Merced Insulation is not responsible for the content, availability, or practices of any third-party site or service.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising from these Terms or from services provided by Merced Insulation shall be resolved in the state or federal courts located in Merced County, California. You consent to personal jurisdiction in those courts.

Changes to These Terms

We reserve the right to update these Terms at any time. We will revise the Effective Date at the top of this page when changes are made. Continued use of the Site after updated Terms are posted constitutes acceptance of those changes. We encourage you to review this page periodically.
